Terms & Conditions

These terms must be accepted in order to use tweeksocial.com. They cover what the service does, how you may use it, how billing works, and where our responsibility begins and ends.

The short version

Use it for real outreach, not spam
Unsolicited bulk messaging gets accounts suspended — ours and yours. Send messages people would reasonably want to receive.
Billing is monthly and recurring
Plans renew automatically until you cancel. You can cancel any time in about a minute through the billing portal.
Your data stays yours
We do not sell or share user information with third parties except where the law requires it.
We are not affiliated with X
Tweeksocial is an independent tool. You remain responsible for complying with X's own rules on your account.

The agreement

The following sets out the terms and conditions for the use of the tweeksocial.com service and is an agreement between Tweeksocial.com and you (either an individual or a legal entity that you represent as an authorised employee or agent). By use of the Service, you agree to be bound by all of these terms and conditions (the "Agreement").

If you do not agree with any part of this Agreement, you must not use the Service. We may update these terms from time to time; continued use of the Service after an update constitutes acceptance of the revised terms.

Privacy

Tweeksocial values the privacy of its users. Tweeksocial will not provide any information about its users and/or their traffic data to any third party company for any purpose, unless required to do so by law.

You will not associate (or permit any third party to associate) any data gathered from your website(s) with any personally identifying information from any source as part of your use of the Service.

You will comply with all applicable local and regional data protection and privacy laws relating to your use of the Service and the collection of information from visitors to your websites. You will have in place in a prominent position on your website, and will comply with, an appropriate privacy policy.

Acceptable use and anti-spam policy

The Service exists to automate legitimate audience growth and direct messaging. It is not a bulk-spam platform, and we enforce that actively rather than decoratively.

Anti-spam policy

We do not tolerate the sending of unsolicited commercial messages or "spam" using the Tweeksocial.com Service. Any customer found to be in violation of this policy will be subject to immediate suspension and account termination.

Prohibited content

You must not use the Tweeksocial.com system to send offensive content, promote anything illegal, or to harass anyone. This includes:

  • Messages that violate CAN-SPAM laws or equivalent regulations in your jurisdiction
  • Offering to sell illegal goods or services
  • Pornographic or sexually explicit content
  • Harassment, threats, hate speech or targeted abuse of any individual or group
  • Impersonation of another person, brand or organisation
  • Phishing, malware distribution or any attempt to obtain credentials

Platform compliance

You remain responsible for ensuring your use of the Service complies with the terms of service of X (formerly Twitter). Tweeksocial provides safety limits, randomised pacing and daily ceilings to help you operate sensibly, but we cannot guarantee the actions of any third-party platform in relation to your account.

Cancellation

Tweeksocial may cancel or delete any account, for any reason, with or without notice. If you wish to cancel your account, you may do so through the customer billing portal or by notifying Tweeksocial by email at info@tweeksocial.com. All information associated with the account, including the account itself as well as historical data, will be permanently deleted.

Cancellation requests submitted by email or chat are processed within 24 hours. Cancelling stops future billing and halts all active campaigns at the end of the paid period; it does not reverse actions already performed on your connected accounts.

Payments

The Service is billed on a monthly basis. All plans automatically recur at monthly intervals. You can cancel your subscription at any time by contacting us, however, Tweeksocial does not offer refunds for any payments already made. Your access to the Service will be deactivated without notice for failure to pay any amount due within seven (7) calendar days of the due date.

Prices are quoted in US dollars and payment processing is handled by a third-party provider. Where a plan has been mis-sold or the Service has materially failed to operate as described, contact us and we will resolve it in good faith.

Ownership

Tweeksocial owns and has rights to all of the intellectual property rights in and to the software and services, including all improvements thereof. All suggestions, enhancements, requests, feedback or recommendations provided by you or any other party shall be owned by Tweeksocial.

You retain ownership of your own content, your connected account and any lists or message templates you create within the Service.

Limitations of liability

The company will not be liable to you or any third party for any indirect, special, punitive, consequential (including, without limitation, lost profits or lost data collected through the service), or incidental damages, whether based on a claim or action of contract, warranty, negligence, strict liability, or other tort, breach of any statutory duty, indemnity or contribution, or otherwise, even if the company has been advised of the possibility of such damages. The exclusion contained in this paragraph shall apply regardless of the failure of the exclusive remedy provided in the following paragraph.

The company's cumulative liability to you or any other party for any loss or damages resulting from any claims, demands, or actions arising out of or relating to this agreement or your usage of the service shall not exceed £250.

Indemnification

You agree to indemnify, hold harmless and defend Tweeksocial, at your expense, against any and all third party claims, actions, proceedings, and suits brought against Tweeksocial or any of its officers, directors, employees, agents or affiliates, and all related liabilities, damages, settlements, penalties, fines, costs or expenses (including, without limitation, reasonable legal fees) incurred by Tweeksocial or any of its officers, directors, employees, agents or affiliates, arising out of or relating to (i) your breach of any term or condition of this Agreement, (ii) your use of the Service, or (iii) your unauthorised use of the script code. In such a case, Tweeksocial will provide you with written notice of such claim, suit or action. You shall cooperate as fully as reasonably required in the defence of any claim. Tweeksocial reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you.

Compliance

You will not use the Service in any way or for any purpose that would violate, or would have the effect of violating, any applicable laws, rules or regulations or any rights of any third parties, including without limitation, any law or right regarding any copyright, patent, trademark, trade secret, music, image, or other proprietary or property right, false advertising, unfair competition, defamation, invasion of privacy or rights of celebrity.

Independence from X Corp

Tweeksocial is an independent product and is not affiliated with, endorsed by, sponsored by or otherwise connected to X Corp. References to Twitter and X are made solely to describe compatibility. We cannot assist with account suspensions, verification, advertising accounts or any other matter that falls under the control of the platform itself.
